Welcome to worklog.ro ("the website"), a platform that allows you to generate work reports and manage projects specific to your company. Your use of this website is subject to the following terms and conditions:

1. Account Creation and Subscription Payment:

   • Companies that need more than 20 user accounts DO NOT have the right to open an account through the web interface and would have to contact us for personalised contracts.
   • To access the full functionality of the website, companies must create a free trial admin account (with limited access time) or pay an annual subscription.
   • The free trial account is free and provides full access to the platform for a limited period of time.
   • The subscription price is specified on the subscription page.
   • Subscription payment will be made online through the Stripe platform, according to the instructions provided on the website.
   • After payment of the subscription, the account will be valid for one year. After this period expires, users will be notified and asked to pay for the next year to continue benefiting from the website's services.
   • ATTENTION to the use of a false or unauthorized CUI: By registering on the worklog.ro platform, the user declares that they have the legal right to use the unique fiscal identification code (CUI) of the registered company. It is strictly forbidden to use a CUI that does not belong to the user or the company they represent. Any attempt at fraud, including the use of a false CUI or another entity without permission, may lead to the immediate suspension of the account, reporting the incident to the competent authorities, and, if necessary, legal action under applicable law (Criminal Code, Art. 249 and 326).

2. Use of the Platform:

   • Admin users are solely responsible for the information provided during account creation and for using the platform in accordance with the terms and conditions set forth herein.
   • Users of worklog.ro are solely responsible for complying with applicable legislation, including the obligation to use the RO e-Invoice system, in accordance with Government Emergency Ordinance no. 120/2021 and the information published on the official website of the Romanian Ministry of Finance. worklog.ro assumes no responsibility for users' compliance with this legal obligation.
   • Access to the user account will be done using an email address and an encrypted password. Users are responsible for securely storing this information and preventing unauthorized access to their accounts.

3. Nature of the Service. Delimitation of Tax Responsibility

   • The worklog.ro platform is a Software as a Service (SaaS) service through which the Provider makes available to Users a software application intended for generating, storing, and electronically transmitting documents, including invoices in a format compatible with the RO e-Invoice system.
   • The Provider offers exclusively technical services consisting of the development, maintenance, and operation of the software platform. The Provider does not perform accounting activities, accounting expertise, tax consultancy, tax representation, or other regulated activities in the financial-accounting field.
   • The User is solely responsible for:
   • the accuracy, legality, and compliance of the data entered into the Platform;
   • the content of the generated documents;
   • compliance with applicable tax legislation;
   • the use of their own qualified digital certificate for authentication and transmission of documents to ANAF systems.

   The transmission of documents to the RO e-Invoice system is carried out exclusively based on the User's digital certificate. The Provider does not act on behalf of, nor as a tax representative of, the User in relation to tax authorities.

   Any automatic validations, notifications, or messages generated by the Platform are strictly technical and informational and do not represent tax consultancy or any guarantee regarding the legal compliance of documents.

   The Provider cannot be held liable for:

   • the rejection of documents by tax authorities;
   • the application of penalties to the User;
   • errors resulting from data entered by the User;
   • temporary unavailability of public authorities' systems.

4. Payments and Refunds:

   • Subscription payments are non-refundable after the legal grace period of 14 days from purchase, in accordance with O.U.G. 34/2014
   • Cancellation of the subscription after payment will not automatically lead to a refund. Any cancellation requests must be sent to the website administrator for evaluation.

5. Privacy and Data Protection:

   • The collection and processing of users' personal data are carried out in accordance with the Privacy Policy of the website, which is an integral part of these terms and conditions. Personal information provided by users will only be used for the purposes stated and will not be distributed or sold to third parties.
   • Users' personal data is stored and processed based on the following legal grounds:
   • Performance of the contract (Art. 6(1)(b) GDPR) - for account creation and administration, providing access to the platform, generating documents, and processing payments.
   • Compliance with the Provider's legal obligations (Art. 6(1)(c) GDPR) - for meeting tax, accounting, and archiving obligations incumbent on the Provider under applicable law.
   • Legitimate interest (Art. 6(1)(f) GDPR) - for ensuring platform security, fraud prevention, service monitoring, and improving service performance.
   • Data subject consent (Art. 6(1)(a) GDPR), where applicable (for example, for commercial communications).
   • Data is retained for the duration of the account and contractual relationship, and after account termination for a period of up to 3 years for the purpose of defending rights in court. Financial-accounting data is retained according to applicable legal obligations (generally 5 or 10 years, under tax and accounting legislation). At the end of these periods, data will be deleted or anonymized, except where the law requires a longer retention period.
   • Disclosure of information to third parties is made only to service providers assisting us in delivering our services (payment processors, hosting, IT services), or to public authorities when required by law. ANAF or other public authorities are not considered processors of our data; the platform uses their technical services for transmitting and receiving e-Invoice documents, without them processing data on our behalf.

6. Limitation of Liability:

   The website cannot be held responsible for any damages or losses suffered by users as a result of using the platform outputs (e.g. reports), regardless of circumstances.

7. Communications and Notifications:

   Any communications or notifications between users and the website will be sent to the email address support@worklog.ro.

8. Applicable Law and Jurisdiction:

   This agreement is governed by the current legislation of Romania, and any dispute arising from or in connection with these terms and conditions will be subject to the jurisdiction of Cluj County.

9. Privacy Policy

   Protecting your personal data is a priority for us. This privacy policy describes the types of information we collect, how we use it, and how we ensure its security.

   1. Information Collected

   We collect personal information when you interact with our website, such as:

   • Contact details (name, email address)
   • Authentication data (username, password)
   • Company information (CUI, J, address, IBAN)
   • Invoice data

   2. Use of Information
